The Law is FLEXIBLE and SELECTIVE when it comes to conspiracy
Conspiracy, under the law, requires certain elements to be charged. These elements are:
- showing that two or more people were in agreement to commit a crime;
- showing that all conspirators must have the specific intent to commit the objective of the conspiracy;
- showing that an �overt act� taken in furtherance of the crime.
In theory, that sounds reasonable; however, in reality, the law is rather SERIOUSLY STRACHABLE and VERY SELECTIVE. Here's how that plays in real life;
On showing that two or more people conspired, the United States WILL CHARGE ONE PERSON ONLY on an alleged conspiracy using the always ready phrase "The named defendant has conspired with others known and unknown" Thus; the two or more co-conspirator requirement is easy to overcome, example Case 09-ri-10002 SDNY where one defendant was indicted alone on a conspiracy.
As to having "Specific Intent"; well, the specific intent requirement does not require that each individual knows all the details of the crime or all of the members of the conspiracy; however, it supposedly requires that the individual understands that the act being planned is a criminal one. Now, the law also states that the "Overt act" does not have to be the crime itself, nor does it have to be an act that is illegal. Rather, the act must merely be a step taken in furtherance of the criminal objective. So is having a dinner with an alleged co-conspirator, or just stay say nothing and staying silent, would that be enough for the government to charge you with conspiracy?
You should know that while an �overt act� implies an affirmative action, some courts have held that silence can be an overt act where it is intentional, planned, and done in furtherance of the conspiracy in-spite of the United States Supreme Court in ou will be charged and found guilty of any alleged conspiracy if the government know that you have money and assets they can confiscate.
